Terms and Conditions of Sale & Use

These general terms and conditions of sale and use of the site (hereinafter, the "GTC") apply between:

1) Seller Identity

The micro-enterprise Maison Mandarine, registered under SIREN number 881 272 678 and SIRET number 881 272 678 00015, with its registered office at 4 Square du Mont Gerbier de Jonc, 78180 Montigny-le-Bretonneux (hereinafter, "We", "Our", "Us", the "Company" or "Maison Mandarine"),
and
Any adult natural person acting exclusively within the strict framework of their personal needs, who consults the website www.maisonmandarine.com (hereinafter the "Site") and/or makes a purchase from Maison Mandarine (hereinafter "You", "Your", "Yours" or the "Client").

The GTC apply to products sold on the Site operated and published online by Maison Mandarine. Any order placed on the Site is subject to the GTC. The GTC are subject to modifications and updates. The GTC applicable to the order are those in force on the day of the order.

All this information is in French. The Client declares to have full legal capacity to commit to these GTC. When registering their data, the Client must pay attention to the accuracy of the information provided. Maison Mandarine cannot be held responsible in case of impossibility to deliver the product due to an error in the address communicated by the Client.

2) Products

Each piece of jewelry offered on the Site is accompanied by one or more photographs and a descriptive text of the precious metals and stones used. This information is indicative and not contractual.

The descriptions and photographs of the products sold on the Site are as accurate and faithful to reality as possible. However, colors, dimensions, textures and other characteristics may be altered by the screens, settings or browsers used. The Client acknowledges that the photographs, descriptions or graphics accompanying the products are indicative and cannot engage the Seller's responsibility in case of error, omission or modification.

Made to order & customization: Maison Mandarine jewelry is, unless otherwise stated, made to order and can be produced according to the Client's specifications (resizing, engraving, adaptation, customization, stone choice, etc.).

Natural variations: Natural stones may show variations in shade, inclusions and reflections. These characteristics, inherent to the natural material, are an integral part of their authenticity and do not constitute a defect.

Products are sold while stocks last. Maison Mandarine reserves the right to limit the quantity of products that may be ordered in a single purchase transaction. Orders may not include more than six (6) products in a single purchase transaction on the Site.

3) Ordering Process

When the Client places an order on the Site, they declare to be of legal age and fully capable of entering into a contract. The Client acknowledges having read and accepted the GTC when validating the order.

Any order placed entails an obligation to pay. The Client undertakes to communicate only real, accurate and valid information. The Client can access and modify their data via "My account" (if available) or by e-mail.

Any order is only deemed validated after receipt and acceptance of payment by Maison Mandarine. Maison Mandarine reserves the right to refuse or cancel any order from a Client with whom there is a dispute relating to a previous order or in case of suspected fraud/violation of the GTC. In this case, the order will be canceled and refunded within a maximum of 14 days.

In case of unavailability preventing delivery within a reasonable time, Maison Mandarine will inform the Client and may offer a similar item. Regardless of the Client's choice, the initial order may be cancelled and refunded within 14 days. Final or temporary unavailability cannot engage the responsibility of Maison Mandarine or give rise to compensation.

4) Prices & Payment Terms

Currency: Prices displayed on the Site are in euros and are inclusive of all taxes (TTC), unless otherwise indicated.

Price changes: Maison Mandarine may change prices at any time. Products are invoiced based on the rate in effect at the time of order validation. Products remain the property of Maison Mandarine until full payment is received.

Payment: Payment is made via a secure platform (e.g., Stripe, Alma, PayPal) or by bank transfer. Communication of the credit card number constitutes authorization to debit.

Invoice: An invoice is sent by e-mail upon order confirmation.

International shipping: For delivery outside the European Union, customs duties or local taxes are the sole responsibility of the Client.

Non-negotiable prices: Prices reflect the costs inherent in excellence and the market prices of materials (precious metals, stones). They are non-negotiable.

5) Deliveries

Ordered Products are delivered within the deadlines indicated on the Site (provided for information purposes) and, at the latest, within a period of 30 days unless otherwise specifically agreed (made-to-order, custom-made, personalized, workshop constraints, etc.).

Deliveries are made in France and internationally, notably via Colissimo, FedEx, Chronopost, or specialized high-value carriers (e.g., Ferrari, Malca-Amit), depending on the nature, value and destination of the product. Delivery costs may be added to the invoiced price.

Delivery against signature: Deliveries are made against signature. No delivery can be made to a hotel address or a post office box.

Transfer of risks: The transfer of risks occurs at the time of the physical handover of the Product to the Client.

In the event of a damaged product upon delivery, the Client must check the condition of the package and the product, make precise reservations on the delivery note and, if necessary, refuse the package. If this verification is not possible, the Client must inform Maison Mandarine as soon as possible with supporting photographs.

Any change of address after the order has been registered may result in a delay. Shipments of multiple products may be split.

6) Right of withdrawal & return policy

Principle: In accordance with Article L221-18 of the Consumer Code, the consumer generally has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision.

Exception — made to order / customization: In accordance with Article L.221-28 3° of the Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalized.
As most Maison Mandarine jewelry is made to order and/or adapted (resizing, engraving, adjustment, customization, stone choice, etc.), it is considered personalized and does not benefit from the right of withdrawal.

Only strictly standard products, unmodified, unengraved, not resized, may potentially benefit from the 14-day right of withdrawal from receipt.

Exercising the right of withdrawal: For an eligible product, the Client must notify Maison Mandarine of their decision via the withdrawal form (Appendix 1) sent to hello@maisonmandarine.com.

Return: Products must be returned in new condition, unworn, unused, in their original packaging and accompanied by the invoice. The return is made at the Client's expense and risk. It is strongly recommended to use insured shipping with tracking.

Refund: After receipt, inspection and validation of the return, the refund will be made within 14 days.
The refund will be made via the same payment method as that used during the order, unless expressly agreed otherwise by the Client for another refund method.

Engraved jewelry

Any personalized engraving makes the jewelry clearly personalized. Engraved jewelry cannot be exchanged or refunded, except in case of non-conformity. The Client is solely responsible for the accuracy (spelling, characters, date) of the text provided for engraving.

7) Warranties, Liability & After-Sales Service

The Products offered comply with French legislation. All Products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

The Client benefits from a period of two (2) years from delivery to act under the legal guarantee of conformity.

The warranty does not cover damage resulting from:

  • normal wear and tear;
  • accidents, shocks, oxidation, exposure to chemicals;
  • improper use or lack of maintenance;
  • interventions (e.g., resizing, repair) carried out by a third-party workshop not approved by Maison Mandarine.

 

Maison Mandarine is only responsible for damages directly caused by it and cannot be held responsible in cases of force majeure, inadequacy with the legislation of a foreign country or dysfunctions related to the Internet network.

After-Sales Service (SAV)

Maison Mandarine offers an after-sales service which may include, depending on technical feasibility and after diagnosis:

  • resizing (within the technical limits of the model);
  • cleaning / polishing;
  • repair or replacement of stones subject to expertise.

The conditions, deadlines and potential costs of the after-sales service are communicated to the Client after diagnosis. Any intervention carried out by an unauthorized third party may void the warranty.

8) Complaints

Non-receipt: In case of non-receipt, the Client can send a complaint to hello@maisonmandarine.com. After investigation with the carrier, a reshipment or refund may be offered depending on the case.

Defectiveness: In case of defectiveness, the Client must inform Maison Mandarine by e-mail, with photographs. If quality control confirms a manufacturing defect, the product will be repaired, replaced, or refunded if repair is impossible, in accordance with legal guarantees.

9) Personal Data Protection

Personal information is essential for order processing and invoicing. Maison Mandarine undertakes not to disclose its Clients' confidential information to third parties, except for service providers necessary for the execution of the order (payment, delivery, customer service).

In accordance with applicable regulations (GDPR and Data Protection Act), the Client has a right to access, rectify, object to, limit and delete their data by contacting hello@maisonmandarine.com or by mail to the registered office.

10) Intellectual Property

The Client acknowledges that Maison Mandarine Products and distinctive signs (trademarks, images, photographs, designs, packaging, Site content) are the exclusive property of Maison Mandarine. Any unauthorized reproduction, representation or use is strictly prohibited.

11) Force Majeure

Maison Mandarine is exempt from its contractual obligations in cases of force majeure as defined by French jurisprudence (strikes, transport blockades, war, terrorism, health crises, severe weather, etc.).

12) Applicable Law, Mediation & Disputes

These GTC are subject to French law. In case of dispute, the Client can contact customer service at hello@maisonmandarine.com.

Mediation: In the event of an unsuccessful complaint, the consumer may have recourse to a consumer mediator free of charge in accordance with articles L612-1 et seq. of the Consumer Code:

Failing an amicable agreement or mediation, the dispute will be submitted to the competent courts in accordance with the rules of common law.

13) General Provisions

Should certain provisions of these GTC become void, this would not affect the validity of the other provisions. The fact that Maison Mandarine does not avail itself of a Client's breach of any of the obligations of the GTC cannot be interpreted as a waiver to avail itself of such breach at a later date.

14) Cookies

The Site uses cookies to ensure its operation, compile statistics, adapt the display and manage the shopping cart. The Client can deactivate cookies via their browser settings, which may, however, alter browsing and certain functionalities of the Site.
